The Court ruled in favour of AdC and condemned EDP and SONAE Groups for non-compete agreement

The Court for Competition, Regulation and Supervision (TCRS) ruled in favour of the Portuguese Competition Authority and condemned EDP and SONAE Groups, within the 2012 partnership created to implement the commercial campaign “Plano EDP Continente”.


However, the Court reduced the total fines amount from EUR 38.3 million to EUR 34.4 million.


Through the non-compete agreement, the undertakings had allegedly committed themselves not to compete in the respective markets, namely, binding Sonae not to compete on the sale of electric power, for a period of two years.


The undertakings can lodge an appeal to the competent appellate court.
